DENVER — Friday, May 30, 2025 — On May 29, 2025, U.S. District Court Senior Judge Christine Arguello ordered that the preliminary injunction prohibiting further construction on the Gross Reservoir Expansion Project be vacated, meaning construction of the dam can move forward as planned.
Denver Water’s official statement on the order to vacate the injunction:
Denver Water looks forward to finishing this critical project to ensure a safe, secure water supply for the region. Completing construction to raise Gross Dam on the current and mandated timeline by the Federal Energy Regulatory Commission is the safest path forward, as reflected by the judge's order.
This added storage is of enormous importance to the 1.5 million people we serve, as well to our West Slope partners who support the environmental benefits to streams and fish habitat associated with the expansion. Denver Water will continue to work through the appellate court to resolve remaining issues and ensure this long-awaited project reaches completion.
Denver Water has already started the appeal process with the 10th Circuit Court of Appeals to address the rest of the judge’s April 3 ruling.
